ONLY CONGRESS HAS OVERSIGHT OVER THE SMITHSONIAN
The Smithsonian derives most of its monies from taxes. Yet it has
successfully argued on the Appeals Court level in Washington DC, that it is not
a Federal Agency. The Smithsonian voluntarily complies with the Freedom of
Information Act, and the laws on Historic Preservation. But it sees these laws
as discretionary to be obeyed when it is in their interest and ignored when it
is not. There can be no judicial recourse. They pick and choose what to obey,
when to obey, and how to obey, or not to obey at all.
The Smithsonian, however, does believe that it is subject to Congressional
oversight. And Congress can write legislation that can require the Smithsonian
to obey the Historic Preservation Act and the Freedom of Information Act.
